Waranaka Versus Maru: Supreme Court Dismisses Application

Peter Wararu Waranaka has filed an Election Petition against the declaration and election of Hon. Richard Maru, MP, Minister for National Planning & Monitoring as Member for Yangoru Saussia Open Seat. Waranaka filed an application to dismiss the affidavits and objections to competencies filed by the Respondents, Maru and Electoral Commission as being filed within time but served out of time.

At the National Court before Justice Makail, Judge Administrator of the Election Petition matters, Waranaka filed an application to dismiss the affidavits and objections to competencies filed by the Respondents, Maru and Electoral Commission as being filed within time but served out of time. The National Court dismissed the application by Waranaka.

The Supreme Court dismissed the application filed by Waranaka and ordered for him to pay the cost of the application to the Supreme Court to the respondent Minister Maru and Electoral Commission.

The decision will now allow Minister Maru and his legal team to file their objection to competency submission together with the Electoral Commission with a view to having the petition dismissed as soon as possible.

The petition is proceeding at the National Court in which preliminary administrative issues have been ironed out and is ready to go for trial in Wewak starting August 2018 and ending September 2018.
